OVERALL BUSINESS TERMS & CONDITIONS - FdAPiX

The terms and conditions detailed on the Assignment or Wedding Booking Form form an integral part of the booking contract.
The precise Terms & Conditions will depending on whether the booking is for an photographic: assignment or a wedding.
No variation to the agreed Terms & Conditions shall be effective unless accepted by Bob Finnegan Photography (FdAPix) in writing.

BOOKING FEE

The booking fee secures the services of FdAPix for the photographic assignment and is Non-Refundable or transferable in the event of cancellation. A  booking fee of £25% of the Photographic Services and 25% of any pre-ordered deliverable is required when the client returns a signed booking contract. Dates are only reserved when the booking fee is paid.

 PAYMENTS

The balance of the payment for the services and deliverables contracted for, must be paid not later than 14 days prior to a wedding or not later than at the commencement of an assignment/event.
Non-payment will result in non-attendance by FdAPix and the loss of the booking fee in toto.
Payment for additional photographs or extras is required when these are ordered.
Any bank charges incurred due to cheques not being honoured will be charged to the client.

 CANCELLATION

Any cancellation following receipt of the booking will result in the loss of the booking fee in toto.
All cancellations must be made in writing to FdAPix.
 Assignments or weddings that are postponed to a later date will retain the booking fee as long as FdAPix can re-schedule for the new date.
All price increases that take place prior to the new date will be added to the contracted cost.

 PHOTOSHOOT

The photographer will endeavour to make the best use of available surrounds and shade in setting up the groups and individuals in order to provide the best images possible, taking account of the location, circumstances and weather conditions.

The photographer may if necessary ask any other person or persons that are taking photos to refrain from taking photos if they feel that they are causing delays or affecting the images are being taken as part of the photoshoot.

The photographer will carry out all necessary pre-photographic  visits, the photoshoot and the processing, editing and manipulation of images in ADOBE Photoshop necessary to produce the agreed and  pre-paid deliverables.

 WEATHER AND/OR DELAYS

Weather permitting the photographs will be taken as agreed. In the event of inclement weather the photographer in co-operation with the client will make the necessary changes to the schedule and will do his best to produce coverage of the photographic assignment within the time allocated to him.  
When delays occur due to circumstances outside his control, the photographer will stay on beyond the agreed time but will charge an additional fee (pro-rata) for the extra time involved. 

LIMITATION OF LIABILITY

In the unlikely event of total photographic failure, Act of God, extreme weather conditions, or any unforeseen circumstances beyond the control of either party the liability shall be limited to the value of the photographic service and deliverables ordered and the booking fee.Neither party shall be liable for indirect or consequential loss. 

COLOUR MATCHING and SIZES

The dyes used for clothing, particularly man made fibres do not always photograph in the manner in which they appear to the eyes. When the photographs are printed to produce a pleasing flesh colour such materials may appear incorrect. Bob Finnegan Photography (FdAPix) will endeavour to achieve the closet possible match within the limitations of materials and processes used.
All quoted sizes are nominal and may be subject to a slight margin of error. Bob Finnegan Photography (FdAPix) accepts no liability for such minor variations in size.   

 COPYRIGHT

The copyright in all photography created by the photographer (FdAPix) shall remain the property of the photographer (FdAPix) in accordance with the copyright, Designs and Patents Act 1988.
The photographer (FdAPix) may use any image that is copyrighted to (FdAPix) as promotional material for display, Internet, banners, posters, leaflets and any advertising in the promoting of (FdAPix).

IMAGE FILES

Image files taken at the Photoshoot will be taken in either RAW or .JPG format. After processing, which may/may not involve some image manipulation/editing the selected images will be made available to the client in .JPG format on CD/DVD. 
 These image files created by Bob Finnegan Photography (FdAPix) shall remain the property of Bob Finnegan Photography (FdAPix). High quality versions of images taken in RAW format will be available to the client in hard/soft copy at an agreed fee, depending on the size of the print or the nature of the image.
Bob Finnegan Photography (FdAPix) will store all image files for a maximum period of 12 months and they will be made available for future reproduction/sale by (FdAPix).
Photographic prints will become and remain the property of the Client(s).

PROOFED PREVIEWS

Proofed previews will be provided on a CD/DVD or in a printed format. 
Previews must be returned to Bob Finnegan Photography(FdAPix) within FOUR weeks, with details of the images required so that the production of the photographic  deliverables (eg; prints/albums) can be completed.
Once (FdAPix) is in receipt of the order and has completed the editing requirements (sizing, colour converting) the expected time before delivery of the order will be within FIVE to SIX weeks, digital art work may take longer. 
The placing of the order for the selected image(s) for the print/album chosen by the client, confirms that the images are of a standard to meet the client’s requirements.
Any complaints should be first raised by the client with FdAPix in writing within 14 days from date of receipt of  images.
